Red House Tools Scratch & Dent Sale Terms & Conditions

These Terms and Conditions (“Terms”) apply to all purchases made through the Company’s Scratch & Dent Sale.

By placing an order, the customer (“Customer”) agrees to be bound by these Terms.

1. All Sales Are Final

All Scratch & Dent Sale purchases are FINAL. No returns, refunds, exchanges, or cancellations will be accepted for any reason, including but not limited to cosmetic condition, size, appearance, or customer preference.

2. Representative Product Images

Products displayed on the Company’s website as part of the Scratch & Dent Sale are representative examples of the types of cosmetic imperfections that may be present. The images shown may not depict the exact product the Customer will receive. Actual cosmetic imperfections may vary in location, type, and severity from those shown online.

3. Cosmetic Issues Only

All products offered under the Scratch & Dent Sale contain cosmetic imperfections only, including but not limited to scratches, dents, scuffs, or discoloration. These imperfections do not affect the product’s functionality, performance, or intended use. Customer acknowledges and accepts that the product will have visible cosmetic issues.

4. Full Functional Use

Each Scratch & Dent product has been inspected and confirmed by the Company to be fully functional and suitable for its intended operational use, notwithstanding cosmetic imperfections.

5. Included Accessories

All Scratch & Dent products will include the Company’s standard RED universal T-Tracks (or other standard included components, if applicable). Additional accessories or packaging may differ from standard new-condition products.

6. No Warranty on Cosmetic Condition

The Company makes no warranties, express or implied, regarding the cosmetic appearance of Scratch & Dent products. Any warranties provided, if applicable, relate solely to functional performance and not to cosmetic condition.

7. Limitation of Liability

To the fullest extent permitted by law, the Company is not liable for any claims, losses, or damages arising from:The cosmetic condition of the product,Variations between representative images and actual products received, orCustomer expectations regarding appearance.

8. Acceptance of Condition 

By completing the purchase, the Customer acknowledges and agrees that:The product will have cosmetic imperfections;The product may differ in appearance from images displayed on the website; andThe purchase is made AS-IS, with all sales final.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of Colorado, without regard to its conflict-of-law principles.
